I
hereby declare that I am exercising my right of withdrawal from the contract
regarding the sale of the goods and/or the provision of the services listed
below. In cases where the notice of withdrawal is directly submitted to the
direct selling company by the consumer, it is mandatory to provide the number,
name, surname, or trade name of the direct seller who carried out the sale.
Right of Withdrawal
The consumer has right to withdraw from the contract
within thirty days without giving any reason and without paying a penalty. Seller,
cannot request the consumer to make any payment under any name or provide any
document that places the consumer under debt in exchange for the goods or
services covered by the contract during the withdrawal period in cases where
the right of withdrawal is exercised.
However this prohibition, if any fee is charged to the
consumer, the fee must be refunded to the consumer immediately. Also any
document that places the consumer in debt is invalid from the consumer's
perspective. Withdrawal period begins on the day
to the consumer or a third party designated by the consumer receives the goods
in contracts relating to the delivery of goods. However the consumer may
also exercise their right of withdrawal during the period from the conclusion
of the contract to the delivery of the goods. The seller or direct sales
company is obligated to take back the goods within 30 (thirty) days from the
date the withdrawal notice reaches them.
Determination of the Period for the Right of Withdrawal
In the case of goods that are the subject of a single order but are
delivered separately, the day the consumer or a third party designated by the
consumer receives the last item.
In the case of goods consisting of multiple parts, the day the consumer
or a third party designated by the consumer receives the last part.
The delivery of the goods by the seller to the carrier shall not be
considered as delivery to the consumer.
It is sufficient for the notification of exercising the right of
withdrawal to be submitted to the seller or direct selling company in writing
or via a durable medium before the withdrawal period expires.
In the exercise of the right of withdrawal, the seller or direct selling
company, to whom the goods are to be delivered at the time the contract is
concluded, is obliged to collect the goods within 30 (thirty) days from the
date the withdrawal notification is received.
In case the consumer directs the exercise of the right of withdrawal to
the direct selling company, it is mandatory to specify the number, name,
surname, or trade name of the direct seller.
Consumers may submit their complaints within the monetary limits
determined annually in December by the Ministry of Trade to the Consumer
Arbitration Committee, or, provided that they apply to a mediator before filing
a lawsuit, to the Consumer Court located either where the goods were purchased
or at their place of residence.
The service subject to direct sales must be performed on the date
specified in the information form.
The delivery date of the goods subject to direct sales shall not exceed
thirty days from the sale date specified in the information form.
The consumer must send the product to be returned via Yurtiçi Kargo, the
cargo company contracted by the seller.
In cases where the information form is not provided, is incomplete, or is incorrectly provided, the consumer is not bound by the thirty-day period to exercise the right of withdrawal. In such cases, the withdrawal period ends one year after the legal withdrawal period has expired
