I hereby declare that I am exercising my right of withdrawal from the contract regarding the sale of the goods or the provision of the services listed below. If the consumer directs the withdrawal notice to the direct selling company, it is mandatory to provide the number, name, surname, or commercial title of the direct seller who carried out the sale.
Right of Withdrawal
The consumer has the right to withdraw from the contract within thirty days without giving any reason and without paying any penalty. The seller may not request any payment under any name or require the consumer to provide any document that places them under obligation during the withdrawal period.
If any payment is collected from the consumer despite this prohibition, the collected amount must be refunded to the consumer immediately. Any document placing the consumer under obligation is null and void.
The withdrawal period begins on the day the consumer or the third party designated by the consumer receives the goods in contracts for the delivery of goods. However, the consumer may exercise the right of withdrawal at any time between the conclusion of the contract and the delivery of the goods.
The seller or the direct selling company is obliged to take back the goods within 30 (thirty) days from the date the withdrawal notice reaches them.
Determining the Withdrawal Period
For goods subject to a single order but delivered separately, the period begins on the day the consumer
or the third party designated by the consumer receives the last item.
For goods consisting of multiple parts, the period begins on the day the consumer or the third party
designated by the consumer receives the last part.
Delivery of the goods by the seller to the carrier is not considered delivery to the consumer.
A withdrawal notice is valid if it is submitted in writing or via a permanent data storage device before the withdrawal period expires.
For the exercise of the right of withdrawal, the goods shall be delivered at the moment the contract is concluded. The seller or the direct selling company must take back the goods within 30 (thirty) days from the date the withdrawal notice is received.
If the consumer directs the withdrawal notice to the direct selling company, the number, name, surname, or commercial title of the direct seller must be stated.
Consumers may submit their applications regarding disputes to the Consumer Arbitration Committee or, within the monetary limits determined annually by the Ministry of Trade, to the Consumer Court after applying to a mediator as required by Article 73/A of the Law.
The service subject to direct selling must be performed on the date stated in the information form. The delivery date of the goods subject to direct selling may not exceed thirty days from the date of sale stated in the information form.
The consumer must return the product via the seller’s contracted cargo company, Yurtiçi Kargo.
If the information form is not provided, or is provided incompletely or inaccurately, the consumer is not bound by the thirty-day withdrawal period. In such cases, the withdrawal period ends one year after the expiration of the legal withdrawal period.
